Terms of Service
These Terms of Service (“Terms”) govern your use of Wish You Well (“we,” “us,” or “our”) at wishyouwellapp.com and our mobile app. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.
1. The service
Wish You Well lets you create personalized, AI-generated video gifts. You choose a tier and template, add a personal message and (optionally) a photo, pay for your order, and receive a shareable video. Because videos are produced by AI, each result is unique and generated automatically.
2. Eligibility and accounts
You must be at least 13 years old (or the age of digital consent in your country) to use Wish You Well. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to use Wish You Well to create, upload, or share content that:
- Is unlawful, harassing, hateful, threatening, or defamatory;
- Is sexually explicit, or depicts or targets minors inappropriately;
- Infringes anyone’s intellectual property, privacy, or publicity rights;
- Uses a person’s photo, name, or likeness without their permission, or impersonates someone in a misleading or harmful way;
- Contains malware, or attempts to disrupt, overload, reverse-engineer, or gain unauthorized access to the service.
We may refuse, remove, or cancel any order or content that violates these Terms, and may suspend or terminate accounts for repeated or serious violations.
4. Your content and licenses
“Your Content” means the messages, recipient details, photos, and other materials you submit. You retain ownership of Your Content. You grant us a limited, worldwide, royalty-free license to host, process, and transmit Your Content to our AI and service providers solely to create, deliver, and support your video gifts.
You represent and warrant that you have all rights necessary to submit Your Content, and that doing so does not violate any law or third-party right. If you upload a photo of another person, you confirm you have their permission to use their image to create a video.
5. AI-generated results
Videos are generated by automated AI models. Results may vary and may not perfectly match your expectations, the template preview, or your exact wording — particularly any on-screen text, which AI video models render imperfectly. You acknowledge that similar prompts may produce similar results for other users, and that we do not guarantee any specific creative outcome.
6. Pricing and payment
Prices are shown at checkout and are currently: Basic $2.99, Standard $4.99, and Premium (Avatar) $6.99 per video. Prices are in U.S. dollars and may change over time; the price shown at checkout is the price that applies to your order. Payments are processed securely by Stripe, and by purchasing you agree to Stripe’s terms in addition to ours.
7. Refunds
Because each video is a custom digital good generated specifically for you, all sales are final once video generation has begun. If generation fails due to a technical problem on our side, you can use the retry option on your order at no additional cost, or contact us and we will re-generate your video or issue a refund. If you believe you were charged in error, email hello@wishyouwellapp.com and we’ll make it right.
8. Intellectual property
Subject to your compliance with these Terms and payment for your order, you may use the final video you create for personal, non-commercial purposes such as sharing it with friends and family. The Wish You Well name, logo, website, software, templates, and underlying technology remain our property or that of our licensors, and nothing in these Terms grants you rights to them beyond the limited use described here.
9. Third-party services
Wish You Well relies on third-party providers, including Supabase, Stripe, Runware, Vercel, and Resend. Your use of the service is also subject to their terms and policies, and we are not responsible for their acts or omissions. See our Privacy Policy for how these providers handle your information.
10. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any video will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, Wish You Well and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for the order giving rise to the claim or ten U.S. dollars ($10).
12. Indemnification
You agree to indemnify and hold harmless Wish You Well and its providers from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your violation of these Terms or any law or third-party right.
13. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination — including content licenses you have granted, disclaimers, limitations of liability, and indemnification — will survive.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Continuing to use the service after changes take effect means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
